Miranda Rights: One of the Most Misunderstood Aspects of Criminal Arrest
This presentation will cover the historical roots of the Fifth Amendment, the earlier Ex Officio Oath and subsequent ramifications, life before Miranda Rights, police interrogation methods, cases that sparked the change in interrogation rights, and the 1966 ruling by the Supreme Court for Miranda v. Arizona. A review of the case law surrounding the Miranda decision reveals that Miranda is a case that has encapsulated the nation’s beliefs and, while subject to the ebbs and flows that come with an elastic and accommodating form of government, remains a vital component of the American criminal justice system. Our discussion concludes with addressing the fears and the realities of implementing Miranda rights.
